How does letting relief work in my circumstances?

Question:
I sold a property that was mainly a buy-to-let. However, I occupied it for about three months before letting it out when I had a sick relative living in my main home. I also occupied the buy-to-let property in between tenancies. Am I entitled to any lettings relief?

Arthur Weller replies:
It is questionable whether living in the property as you did makes it your qualifying principal private residence (PPR), enabling you to claim a certain amount of PPR relief and lettings relief, or not. You may want to consider claiming PPR relief and lettings relief (i.e. the amount you are eligible for) in the tax return but explain all the facts of your case in the white space of the tax return, and wait for HMRC to come back to you with any objection
