Buy to let as a full-time investor: Under my name or a company for tax purposes?

Question:

I am an overseas investor, planning to live in the UK in the future and becoming a full-time investor. Should I invest in buy-to-let (BTL) properties under my own name, or a company for a better tax position and transfer to my spouse in the future?

Arthur Weller replies:

This is not the forum to answer your question properly. But on a very basic level, it is generally better to invest personally. However, if this will result in you and your wife being higher rate taxpayers, and if you need to borrow to fund your investments so that 'section 24' restriction in tax relief for interest relief etc. rules become relevant, then you should consider a property investment company.
