Reduced Inheritance Tax by £340,000 A family business which had several investment properties as well as a trade asked me to look at the likely inheritance tax implications if one of the partners were to die. I produced a report identifying the problems with the current situation (IHT of £400,000 on the death), and suggested a restructuring of the business to get Business Property Relief at 100% on nearly all the assets, reducing the potential IHT cost by £340,000.
£13,000 should be added to the profits for the year! An Inland Revenue tax investigation into the accounts of a pub had been going on for about 18 months, and the inspector of taxes was arguing that over £13,000 should be added to the profits for the year, saying that he had “information” about unrecorded sales of food and drink. I was asked to advise, and wrote a letter to the inspector pointing out the inconsistencies in the “information” he claimed to have, and inaccuracies in his analysis of the business records. He replied agreeing to close the investigation down with no additions to the profits.
Reduced a £65,000 tax cost to NIL. Two shareholders in a struggling family company had agreed to buy out the three other shareholders. Their accountants estimated that the tax cost of the proposed deal could be up to £65,000, and asked me to suggest a more tax efficient way to achieve the desired result. I was able to suggest a restructuring of the deal that reduced the tax cost to NIL, and left the three shareholders who sold their shares with up to £250,000 of tax losses to offset against future capital gains.
Significant savings by following tax advantages After a family company was sold, there was a dispute between the old and the new owners, and they had agreed to settle things by the old owners writing off a debt of £75,000 owed to them by the company. I was asked to comment on the tax implications, and was able to show how the same financial result could be achieved in a different way with the following tax advantages:
- The company saved £14,250 in corporation tax;
- The old shareholders got a tax repayment of £7,500
- The new shareholders got £75,000 cash, with no tax to pay
I can happily recommend Arthur Weller's professional advice. I'd been very frustrated over a ten week period consulting two other supposedly 'expert' online tax consultants who, after weeks of consideration, could not, after all, definitively answer my question for their sub £100 fee unless I was prepared to fork-out up to £700+ in more dedicated research. Arthur, however, impressively answered the question within a couple of days, inc some follow-up clarification, for a flat fee. I was truly stuck on a property transaction until this question was answered, so in my opinion a great service.
